ABSTRACT

 

The process of drafting the state constitution in Myanmar is itself the meaningful political bargaining process towards peace building. It is a critical stage which can determine the future of the transformation of federalism in Myanmar. The plan of drafting state law in Shan state has been discussing for more than a decade, but officially the serious return of this debate started in the 21st Panglong Peace Conference/ Union Peace Conference, which was conducted three times in the capital of Myanmar–Nay Pyi Taw. However, the questions of why should state constitution be designed at the State level, how and who is going to organize the political dialogue platform are still remained and needed to push forward among ethnic nationalities. One possible solution highly recommended here is to design the deliberative processes in which different stakeholders will be included in different stages of the state constitution formulation. Most importantly, these stakeholders need to represent several ethnic groups and different political backgrounds.
